Terms of Service

These Terms of Service ("Terms") govern your use of Customata and any other applications ("Apps") developed and published by Pogolli ("we", "us", "our") on the Atlassian Marketplace. By installing or using our Apps, you agree to these Terms.

1. License Grant

Subject to these Terms and a valid license obtained through the Atlassian Marketplace, we grant you a non-exclusive, non-transferable, revocable license to use our Apps in accordance with the documentation provided and the license tier you have purchased.

2. Atlassian Marketplace

Our Apps are distributed through the Atlassian Marketplace and are subject to the Atlassian Marketplace Terms of Use. In the event of any conflict between these Terms and the Atlassian Marketplace Terms of Use, the Atlassian Marketplace Terms of Use shall prevail with respect to the distribution and licensing of the Apps.

3. Subscription and Billing

Our Apps are offered as "Paid via Atlassian." All billing, subscription management, renewals, and refunds are handled by Atlassian in accordance with their policies. A 30-day free trial is available for new installations. After the trial period, continued use requires an active paid subscription.

4. Permitted Use

You may use our Apps only for their intended purpose within supported Atlassian products. You agree not to:

• Reverse engineer, decompile, or disassemble the Apps
• Modify, adapt, or create derivative works based on the Apps
• Redistribute, sublicense, or resell the Apps outside the Atlassian Marketplace
• Use the Apps in any way that violates applicable laws or regulations
• Attempt to circumvent any licensing or security mechanisms

5. Data Handling

Our Apps run on the Atlassian Forge platform. All application data is stored using Atlassian-hosted storage (Forge Storage). We do not maintain external servers or databases. Certain features, such as the Web Request node in Customata, allow you to configure outbound HTTP requests to external services of your choosing. You are responsible for ensuring that any data sent to external services complies with your organization's data governance policies.

6. Support

We provide support via email during business hours (Monday–Friday, 9:00–18:00 CET). We aim to respond to inquiries within one business day. Support includes assistance with installation, configuration, and troubleshooting of our Apps. Support does not include customization, consulting, or assistance with third-party integrations configured through the Apps.

7. Availability and Updates

We strive to keep our Apps available and up to date, but we do not guarantee uninterrupted availability. We may release updates, bug fixes, and new features at our discretion. As our Apps run on Atlassian Forge, their availability is also subject to the availability of Atlassian's platform and services.

8. Intellectual Property

All intellectual property rights in the Apps, including but not limited to code, design, and documentation, remain with Pogolli. These Terms do not transfer any ownership rights to you.

9. Disclaimer of Warranties

Our Apps are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Apps will meet all of your requirements or that their operation will be error-free.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Pogolli shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses resulting from your use of the Apps. Our total aggregate liability shall not exceed the amount you paid for the Apps in the twelve (12) months preceding the event giving rise to the claim.

11. Termination

These Terms remain in effect as long as you have an active license for our Apps. We may terminate or suspend your access if you violate these Terms. Upon termination, your right to use the Apps ceases immediately. Sections regarding intellectual property, limitation of liability, and disclaimers survive termination.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our Apps after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which Pogolli operates, without regard to conflict of law principles.
